Tiki Tides Naples – Liability Waiver and Release
1) Assumption of Risk: I understand that boating involves inherent risks, including but not limited to injury, drowning, slips/falls, sun exposure, dehydration, mechanical failure, and accidents due to weather, tides, waves, or other environmental conditions. I voluntarily assume all such risks for myself and any minors accompanying me.
2) Alcohol & BYOB Policy: Tiki Tides Naples operates on a BYOB basis. I accept full responsibility for any alcohol I or my party bring aboard. I acknowledge that excessive consumption increases risk and agree to drink responsibly. No alcohol will be provided or served by the operator or crew.
3) Minor Participation: Minors (under 18) are only permitted aboard with a parent or legal guardian present. As parent/guardian, I accept full responsibility for any participating minor under my supervision. If alcohol is being consumed on board, all passengers must be 13 years of age or older and any minors must be accompanied by their parent or legal guardian.
4) Medical Disclosure: I certify I am fit to participate and do not have any condition that would prevent safe participation.
5) Release and Waiver: I, on behalf of myself, my heirs, assigns, and personal representatives, release and discharge Tiki Tides Naples, its owner(s), operator(s), employees, agents, and affiliates from all liability, claims, demands, or causes of action for any injury, loss, or damage arising from my participation, whether caused by negligence or otherwise.
6) Indemnification: I agree to indemnify and hold harmless Tiki Tides Naples and its operators from any legal fees, claims, or damages resulting from my conduct or the conduct of anyone in my party.
7) Photo/Video Release (Optional): I grant permission for photos or videos taken during the charter to be used in promotional materials unless I notify Tiki Tides Naples in writing prior to the trip.
8) Safety & Captain’s Authority: I understand the USCG-licensed captain may modify, postpone, or terminate a trip for safety (including weather/tides) at their sole discretion. I agree to follow all instructions and coast guard regulations, including the maximum passenger limits.
9) Jurisdiction & Venue: This agreement is governed by the laws of Florida, and any disputes shall be resolved in the courts of Collier County, Florida.
I have read and understand this waiver, and I accept its terms voluntarily.
